By accessing or using the Derva platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the Service. These terms apply to all visitors, members, and other users who access or use the platform.
2. Membership and Accounts
Membership in Derva is subject to an application and review process. Submitting an application does not guarantee acceptance. We reserve the right to approve or decline any application at our sole discretion. Once approved, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. User Conduct
As a member of Derva, you agree to:
- Treat all community members with respect and professionalism
- Not upload, share, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Not infringe upon the intellectual property rights of others
- Not attempt to gain unauthorized access to the platform or other members' accounts
- Not use the platform for commercial solicitation without prior written consent
- Comply with all applicable local, national, and international laws and regulations
4. Intellectual Property
All content provided through Derva, including but not limited to text, graphics, logos, images, videos, and educational materials, is the property of Derva or its content creators and is protected by copyright and intellectual property laws. Members retain ownership of the artwork and content they upload. By submitting content, you grant Derva a non-exclusive, royalty-free license to display your work within the platform for the purpose of operating the community.
5. Auctions and Transactions
Derva facilitates auctions between members. We act solely as a venue and are not a party to any transaction between buyers and sellers. Sellers are responsible for the accuracy of their listings, and buyers are responsible for reviewing items before bidding. All sales are final unless otherwise agreed upon by the parties involved. Derva is not liable for any disputes arising from transactions between members.
6. Content and Videos
Educational videos, articles, and other learning materials provided through the platform are for personal, non-commercial use by active members only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of the content without prior written permission from Derva or the respective content creator.
7. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms, is harmful to other members or the community, or for any other reason. Upon termination, your right to use the Service will immediately cease. You may also request to deactivate your account at any time by contacting us.
8. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. Derva makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Service. In no event shall Derva, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Derva operates, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the applicable arbitration rules.
